The 2027 Bay Area Water Heater Rule, and What It Means for Your San Jose House

This is the question we get asked most often right now, usually phrased as some version of "am I about to be forced to rip out my water heater?" The short answer is no. The longer answer is worth five minutes of your time, because the age of your current tank matters a great deal more than the date on the calendar.

The Bay Area Air Quality Management District adopted an amendment to what it calls Rule 9-6, and from January 1, 2027 new residential water heaters sold or installed in the nine Bay Area counties have to be zero-NOx units. In practice, for most houses, that means a heat pump water heater rather than a gas one. It applies to gas tank heaters and gas tankless units alike.

What it does not do is touch the heater you already own. Nobody is coming to your house. If your gas water heater is sitting in the garage working fine, you can keep using it, and you can keep having it repaired, for as long as it has left. The rule governs what can be sold and installed going forward, not what is already in service.

So why does anybody care? Because of what happens when a tank fails. Water heaters do not usually give you much notice. You go out to the garage and there is water on the floor, and you want hot water back today. If that happens after the deadline and your house has never had an electric heater, the replacement is a bigger job: it needs an electrical circuit run to it, and it needs somewhere to sit that suits a heat pump. That is not a two-hour swap. It is a job with an electrician in it.

Pull up the label on your tank and find the date. If it is under about eight years old, you have time, and there is no reason to do anything except keep an eye on it. If it is ten years old or more, you are already in replace-soon territory regardless of any rule, and you now have a decision to make on your own schedule rather than on the schedule of a tank that just let go on a Sunday.

People also ask whether the heat pump units are any good. They are genuinely efficient, they cost more up front than a gas tank, and there is a meaningful pile of rebates and credits floating around that changes the arithmetic, enough that it is worth getting current numbers rather than going on what somebody told you last year. They are also physically larger and they want some air around them, so where your current tank sits matters.

What we would suggest: do not panic-replace a healthy heater to beat a deadline, and do not ignore a tired one because you are hoping to squeeze another two years out of it. Find the date on the label. If you want a second opinion on what you are looking at, call and describe it to us. The call is free, and we will tell you whether you are looking at this year or in five years.
